Falkirk Community Trust welcomes requests for information and complies with legislation on Data Protection, Environmental Information Regulations, the Re-use of Public Sector Information Regulations and Freedom of Information. This guidance tells you what you can expect and how to make a request for information.
What can I ask about?
Everyone has a legal right to see information held by Scottish public bodies. Our Guide to Information lists the information we routinely make available.
There are different regulations for different types of information:
Information about you
Information about the environment
Re-use of Public Sector Information
Information about anything else
Information about you
You have a right under the Data Protection Act to see certain information held by us about you. We may hold information about you to enable us to provide you with the best services. This may include your name and contact details and if you are a member of staff will include information held on a personnel file. As a controller of personal data, we are registered with the Information Commissioner's Office (ICO).
If you want to see this information then:

- You need to be specific about what you want
- You must provide proof of your identity (preferably a copy of your driving licence or passport)
There may be a charge for providing the information.
We have one month to respond to your request. Which we can extend by a further two months if your request is complex or we have recieved a number of requests from you. There are exemptions in the legislation which may mean that we do not need to comply with all, or part, of your request. If you are not happy with how we deal with your request, please let us know and we will try to resolve your complaint. If you are still not happy, you should contact the Information Commissioner's Office (ICO).
Information about the environment
You have a right under the Environmental Information Regulations to see the information we hold about the environment, such as environmental information about our parks and cultural sites, or policies, plans and agreements relating to the environment.

There may be a charge for providing the information.
We have 20 working days to respond to your request. We may extend this to 40 working days if a large amount of information or complex information is requested. If this is the case, we will let you know.
Sometimes there will be reasons why we cannot provide the information you want. If this is the case we will tell you why. You can challenge our decision and ask us to review our response. You can find more details in our Right to Complain leaflet. If you are still not happy after the review, you should contact the Scottish Information Commissioner (SIC).
Re-use of Public Sector Information
We encourage the re-use of our information and comply with the Re-use of Public Sector Information Regulations 2015. You are free to re-use any information about Falkirk Community Trust which we publish on our website except for information about or any images from our Libraries, Museum or Archive Collections.
If you want to re-use information or images from our Libraries, Museums or Archive Collections then you should contact the relevant service. The regulations do not apply to any items where the copyright belongs to someone else. Charges apply for providing copies of the images or the collections. We calculate our charges from the direct costs, a proportion of indirect costs and a reasonable return on our investment in maintaining the collections.

You have a right under the Freedom of Information (Scotland) Act to see any other information we hold that is not covered in the above three types of information.

There may be a charge for providing the information, if, for example, you ask for a lot of information or if the information would take a long time to produce.
We have 20 working days to respond to your request. Sometimes there will be reasons why we cannot provide the information you want and sometimes there will be reasons why we will refuse to give the information to you. In these cases, we will tell you why. You can challenge our decision and ask us to review our response. You can find more details in our Right to Complain leaflet. If you are still not happy after the review, you should contact the Scottish Information Commissioner (SIC).
